Terms of Service

The deal between you and SURGE, in plain English. The short version: the app is free, Pro buys more AI coaching, it is run by one person, an AI writes the training plans, and it is not your doctor.

What SURGE is

SURGE is a workout planning and training log. You describe your goal and it drafts a weekly plan; you can edit that plan by hand, start from a ready-made template, log your sessions set by set, track personal records and body weight, build your own workouts, and get reminders on training days. An AI coach ties it together in a chat.

It is operated by {{OPERATOR_NAME}}, a private individual in Ukraine. The app itself is free — logging, plans, HIIT, progress, reminders, sharing and export cost nothing and are not going behind a paywall. The one paid option, Pro, raises how much you can use the AI coach each day; see paying for Pro. Using SURGE means you accept these terms and the Privacy Policy. If you do not accept them, do not use it.

This is not medical advice

SURGE is a fitness tool, not a doctor, physiotherapist or qualified coach. Nothing in the app — plans, exercise suggestions, load recommendations, anything the AI coach says — is medical advice, diagnosis or treatment. Talk to a physician before you start a new training programme, and especially if you are pregnant, recovering from an injury or illness, taking medication, or have a heart, joint or back condition.

Strength training carries real risk of injury. Weights are heavy, form breaks down under fatigue, and a plan on a screen cannot see that your knee is not tracking properly today. You are the one deciding what to lift, and you do it at your own risk.

Practical version of the same point:

  • Stop if something hurts in a way that is not ordinary training effort.
  • The suggested weights are arithmetic on your own logged numbers, not a judgement about what your body can take today. Lower them whenever it makes sense.
  • Telling the coach about an injury makes it program around that injury. It does not make the plan safe, and it does not make the coach qualified to treat you.
  • If you are new to lifting, get someone who knows what they are looking at to check your technique. No app can do that.

The AI coach, and what it gets wrong

The plans and replies come from a large language model. That means they are generated, not reviewed by a human, and they can be wrong: a mistimed deload, a silly volume jump, an exercise that makes no sense for your equipment, or a confident answer that is simply untrue. The app validates the machine-checkable parts — plans may only use real exercises from the catalogue, and constraints you have set are enforced — but nobody checks the coaching judgement.

Treat every plan as a suggestion to sanity-check, not an instruction to follow. You are expected to apply your own judgement, and the manual plan editor exists precisely so you can overrule the machine.

Your account

You can use most of SURGE without an account. If you create one, you are responsible for keeping access to it — use a password you do not use elsewhere, and do not share the account. Tell us at {{CONTACT_EMAIL}} if you think someone else has got into it.

You must be at least 16 years old to use SURGE, and the information you give it — age, weight, injuries — should be accurate, because the coaching is built on it.

Acceptable use

Do not:

  • use SURGE for anything illegal, or to harm, harass or impersonate somebody else;
  • try to break, overload or circumvent the service — including working around the daily coach limit with scripts, multiple accounts or rotating addresses;
  • resell the service, or use the AI coach as a free backend for something else you are building;
  • probe, scan or attack the infrastructure, or try to reach data belonging to other users;
  • upload content into shared workouts that you have no right to share, or that is abusive or unlawful.

Genuine security research is welcome — report what you find to {{CONTACT_EMAIL}} rather than exploiting it.

The daily coach limit

Every coach message costs real money to run, so the coach has a daily allowance. This is a designed limit, not a fault:

  • Signed out: a few messages a day, enough to see whether the coach is any good.
  • Free account: 15 messages a day.
  • Pro: 50 messages a day.
  • There is also a ceiling across everyone using the app, so a single heavy day cannot exhaust the budget for everybody.

Reaching your limit pauses the coach until midnight UTC. Everything else keeps working — your plans, logging, templates, progress and reminders never depend on the AI. These numbers can change as costs do, and the coach may be paused entirely for a while if the bill demands it.

Paying for Pro

Pro costs $5 a month or $50 a year, and the only thing it changes is the daily coach allowance above. Prices are in US dollars before any tax that applies where you live. The current plans are always on the pricing page.

Who you are paying

Payments are processed by Paddle, who act as the merchant of record: they are the seller for the transaction, they charge and remit the correct tax for your country, and they issue your invoice. Your card details go to Paddle and are never seen or stored by SURGE. Paddle’s own terms apply to the payment itself.

Renewal and cancellation

A subscription renews automatically at the end of each period until you cancel. You can cancel at any time from Account → Manage billing, which opens Paddle’s portal. Cancelling stops the next renewal; Pro keeps working until the end of the period you have already paid for, and then the account returns to Free with nothing lost — your plans, logs and history are not touched. Deleting your account cancels the subscription first, so a deleted account can never keep being charged.

Refunds and your right to change your mind

If you are a consumer in the UK or the EU you have a 14-day right to withdraw from a purchase. Because Prois digital content supplied immediately, starting to use the raised allowance within those 14 days means asking for it to be supplied straight away, which ends the withdrawal right for what you have used. Outside that, refunds are at Paddle’s and our discretion — but if something on this side was broken and you could not use what you paid for, ask, and you will get your money back.

If prices change

Prices can change. An existing subscription keeps its price for the period already paid for, and you will be told before a change applies to a renewal, with time to cancel first. If the free allowance is ever reduced, that reduction will not be applied retroactively to accounts that already exist.

Your data and your content

Your training data is yours. Creating a plan or logging a workout does not hand over any ownership of it, and it is not used to train AI models by SURGE. You can export everything from the Account page at any time, and delete it just as easily.

When you create a share link you are choosing to publish that workout to anyone holding the link, for 30 days. Only share what you are happy for other people to see.

The app itself — its code, design, wordmark and exercise catalogue presentation — is not yours to copy or rebrand. What is stored about you, and where it goes, is set out in the Privacy Policy.

Availability, and no warranty

SURGE is provided as is, with no warranty of any kind — express or implied, including fitness for a particular purpose and uninterrupted availability. It is run by one person in their own time. It can go down, lose a feature, change how something works, or stop entirely. If a paid subscription is running when SURGE shuts down, the unused part of the period you paid for is refunded.

Export your data if you would be upset to lose it. The export buttons are there for exactly this reason, and using them occasionally is a better backup strategy than trusting a free app to exist forever. Nothing here limits rights that consumer law gives you and does not allow to be waived.

Ending your account

You can leave at any time: Account → Delete my account removes the account and the data synced to it, immediately and permanently. No notice, no email exchange, no retention period. If a Pro subscription is running, it is cancelled before anything is deleted, so it cannot survive the account and keep charging you.

Access may be suspended or ended from this side if you break these terms — abuse of the service, attacks on the infrastructure, or illegal use — or if SURGE is shut down altogether. Where it is reasonably possible, you get warning first and a chance to export your data.

Limitation of liability

To the fullest extent the law allows, {{OPERATOR_NAME}} is not liable for injury, illness, lost data, lost progress, or any indirect or consequential loss arising from your use of SURGE — including from following a plan the app produced. You train at your own risk, and the decision about what to lift is yours.

Nothing in this section excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded under the law that applies to you. Any liability that does survive is limited to what you paid for SURGE in the twelve months before the claim — which is nothing at all on the free plan, and the subscription fees you actually paid on Pro.

Governing law

These terms are governed by the law of Ukraine, and disputes belong to the courts of Ukraine. If you are a consumer in the EU or the UK, this does not take away the protection of the mandatory consumer law of the country you live in, or your right to bring a claim there.

Changes to these terms

These terms can change — for a new feature, a new legal requirement, or a paid tier that does not exist yet. The date at the top changes when they do. If a change materially affects your rights, signed-in users are told by email before it takes effect. Continuing to use SURGE afterwards means you accept the new version; if you do not, delete your account.

If any part of these terms turns out to be unenforceable, the rest still stands.
